I have done several Expert Witness deals over the years, most on F&I Compliance lawsuits. Yesterday, I received a few emails about a lawsuit that an Illinois dealer filed against a Law Firm and a Consulting Firm in Florida.

While the article provided some information, there really isn’t enough to provide an opinion on who will prevail.

The article states the lawyer reviewed “deal bags”, but we don’t know if it was only to confirm the proper documents were filed or did the lawyer do a more detailed “Forms Review” to make sure the dealership was in compliance.

Without a copy of the Engagement Agreement, we really don’t know the scope of the audit that was promised.

My other question would be regarding the software provider that produced the contract and if there is any liability on their part.

This will be an interesting case to follow.
